CALENDAR YEAR 2004
Beginning with calendar year 1999, the Annual Security Report of Colleges and Universities was modified from prior reports in order to comply with revisions mandated by Congress. The revisions, known as the Clery Act, require colleges and universities to provide much more information than was previously called for in annual reports. Some of the information enclosed in this report is also found in the Midland College Catalog and Student Handbook.
CRIME STATISTICS
Crime statistics for the past three years are contained in this report as Appendix A.
CRIME REPORTING PROCEDURES
All thefts, accidents, offenses, criminal activity, and incidents requiring police investigation should be reported immediately to the College Police Department by telephoning the Department at (432)685-4734. If there is no answer the call will be forwarded to the PBX operator during the hours of 8:00 a.m. to 9:45 p.m. weekdays. At other times, if there is no answer, the caller should call 911, which will connect them with the Midland Police Department. The Midland Police Department will respond or notify a member of the Midland College Police Department of the nature of the call.The College Police Department is located in the Scharbauer Student Center near the recreation room. MC police officers can be contacted by telephone or radio during all hours in which classes are in session by calling the numbers listed in the above paragraph. Between the hours of midnight and 7:00 a.m. on weekdays and all day on weekends, the campus is patrolled by security personnel employed by Midland College, and can be reached by calling pager number 560-4364. These officers will respond to any call and make referral if necessary to a College Police Officer or the Midland Police Department.Residents in need of assistance should call their housing supervisor, who will in turn contact the proper authority. Upon investigation of an incident, accident, or crime on campus, a written report will be prepared and filed at the College Police Department. Copies of reports may be available to the proper individuals who need the information in the reports. In addition, a daily activity log is maintained at the College Police Department office for review by anyone.
CRIME WARNING PROCEDURES
In the event of a need for warning students and others of crimes occurring on campus, the College Police Department will publish the information on the Midland College Internet for dissemination to employees and students. Faculty is requested to advise students of situations requiring increased caution. All Midland College full and part time staff and faculty who receive reports of criminal offenses from students or employees must file a report with the Campus Police Department and notify the Vice President of Student Services.
ANNUAL STATISTICAL REPORT
Every year, during the Spring Semester, the Campus Police Department will gather data from Student Services as well as from the Midland Police Department and its own records in preparation for publishing the annual statistical report. The Vice Presidents of Student Services and Administration will review the material prior to publication in order to ascertain that all relevant data is included. Once the data has been approved, the statistics will be prepared and distributed as Appendix 1 to the Annual Report required by the Clery Act. The statistical report will include non-arrest incidents resulting in referrals for campus disciplinary action for Liquor Law Violations, Drug Law Violations, and Illegal Weapons Possession.
CONFIDENTIAL REPORTS
In addition to reports made publicly to the Midland College Police Department, victims or witnesses to a crime may report the information on a voluntary, confidential basis for inclusion in the annual statistical report. Such reports may be made anonymously in writing to the Campus Police Department or the Vice President of Student Services. No effort will be made to learn the identity of the one reporting.Individuals who do not want to reveal their identity may report crimes or other information to a designated individual without fear of reprisal. Such disclosure will be given to the Campus Police Department by the one receiving the report without revealing the identity of the one reporting the information. Such information will be included in the Statistical Report, if appropriate.
SECURITY AND ACCESS TO CAMPUS FACILITIES
All buildings on the Midland College Campus will be open during the time for regular classes. At all other times buildings on campus will be open on an as-needed basis, by scheduling with the Midland College Police Department for them to be unlocked. After classes have concluded for the day, the Police Department will check all doors and secure the buildings.
Residence Halls will be secured at all times, other than moving day, by locking the doors from the lobby to the hallways leading to residences. During the evening hours the front doors to the residence halls will be secured as well. Access will be through electronic keys or pass codes. Employees and students are asked to help maintain the security of buildings by checking doors upon leaving to make certain that they have latched.
CAMPUS LAW ENFORCEMENT POLICIES
There are two groups of security/law enforcement personnel employed by Midland College; security officers and police officers. Security officers may arrest for a felony committed in their presence or an offense against the public peace, which is the same authority granted to any person. Police officers have arrest authority for any offense committed within their presence or view, or in execution of a warrant of arrest. In addition, Midland College has entered into an agreement with the Midland Police Department in which the Midland Police Department has agreed to respond to the campus when requested to assist Midland College as needed. Members of the Texas Department of Public Safety will respond to a call from the Midland College Police Department should there be a problem of such magnitude that the Midland College Police Department is unable to handle the situation. All reports of crime or other requests for assistance will be handled promptly by the Midland College Police Department. Time is often of the essence in such situations, and students and employees are encouraged to report as quickly as possible in order to enhance the opportunity for apprehension of any offender who may be at large. For individuals who do not want to be publicly involved, counselors or other campus employees designated, such as residence hall supervisors, should encourage the reporting of crimes or other suspicious activity through the counselor or a member of the Police Department, in confidence, in order to create an awareness of criminal activity which should be monitored.
INFORMATIONAL PROGRAMS
The Midland College Student Government Association and Residence Life periodically schedule educational programs to promote the awareness of rape, acquaintance rape, and other forcible and nonforcible sex offenses. Program attendance is voluntary.All Midland College full and part time staff and faculty who receive reports of sex offenses from students or other employees must file a report with the Campus Police and notify the Vice President of Student Services. The victim should be encouraged to seek medical assistance including the completion of a medical rape kit. A mental health professional may also be contacted by the Campus Police or the Vice President of Student Services or his designee. All students will be encouraged to contact the Campus Police or the Midland Police Department. Midland College personnel will assist the student with notifying the necessary authorities.Victims of sexual offenses and Midland College residents will be given information concerning counseling, mental health, and other resources available for victims of sex offenses.Victims of alleged sex offenses will be notified by the Vice President of Student Services or his or her designee of the options for changing a victim’s academic and/or living situation as requested by the victim and as is reasonably available.In cases of sexual offenses, the Midland College Due Process procedure will be followed. These procedures are located in the Student Handbook.Both the accuser and the accused must be informed of the outcome of any institutional disciplinary proceeding brought alleging a sex offense. Compliance with this paragraph does not constitute a violation of the Family Educational Rights and Privacy Act (20 U.S.C. 1232g). For the purpose of this paragraph, the outcome of a disciplinary proceeding means only the institution’s final determination with respect to the alleged sex offense and any sanction that is imposed against the accused.Sanctions will be determined according to the Midland College Due Process procedure and may include fines, restitution, probation and mandatory counseling, removal from the residence hall and/or college.
ENFORCEMENT OF ALCOHOLIC BEVERAGE LAWS
In accordance with the Drug Free Schools and Campuses Drug Prevention Program Certification, Midland College has adopted and implemented a program to prevent the unlawful possession, use or distribution of illicit drugs and alcohol by its students and employees on school premises or as a part of any of its activities. Midland College recognizes that drug and alcohol abuse is a persistent social and health problem of major proportion in our society. Members of the college community, as members of the greater society, may have social, environmental and personal characteristics which could foster such abuse. Midland College is committed to taking positive steps to address drug and alcohol abuse through education, treatment and enforcement. Therefore, provided here for the benefit of each student and employee are standards of conduct; legal and disciplinary sanctions for unlawful possession or distribution of illicit drugs and alcohol abuse; area resources for drug/alcohol counseling, rehabilitation and reentry programs; and a description of health risks associated with the use of illicit drugs and the abuse of alcohol.
Standards of Conduct
Alcohol:
A. The College prohibits possession and consumption of alcoholic beverages in public places on campus except where authorized.B. The College strictly enforces the state law that prohibits the possession and consumption of alcohol by those under the age of twenty-one (21).C. The College strictly prohibits attending classes while under the influence of alcohol.
Controlled Substances (Drugs)
A. The College prohibits possession or the use of controlled substances or drugs on its campus, in its residence halls, or at any off-campus college-sponsored event.B. The College strictly enforces the local, state, and federal laws which prohibit the sale of controlled substances on its campus.
Midland College Sanctions
All employees and students are expected and required to obey the law, to comply with Midland College’s rules and with directives issued by an administrative official in the course of his or her authorized duties. Employees and students are expected to observe standards of conduct appropriate for an academic institution.
When the Standards of conduct regarding alcohol and drugs are violated, Midland College will impose one or more of the following disciplinary actions: a) admonition and warning, b) formal written warning, c) fines, d) loss of privileges, e) formal disciplinary probation, f) suspension, or g) dismissal.
College-imposed sanctions are additional to any legal actions taken by College, local, state, or federal authorities.
Legal Sanctions
Legal sanctions are necessary to discourage reckless actions resulting from drug or alcohol consumption while on campus or attending an event sponsored by Midland College.Employees and students found in violation of any local, state or federal law regarding the use, possession, or distribution of alcohol or other drugs (such as defined by the Texas Health and Safety Code, Subtitle C, Substance Abuse Regulations and Crimes) will receive the full legal penalty in addition to any appropriate disciplinary action. The most common legal violations and their consequences are:
Alcohol
Minors convicted for the possession or consumption of alcoholic beverages may be subject to fines ranging from $25 to $500 depending on the number of previous convictions.Convictions for selling to minors may subject individuals to fines ranging from $100 to $1000 and to a maximum of one year in jail.Convictions of Driving While Intoxicated may subject individuals to fines ranging from $100 to $2000 and to a jail term ranging from three days to two years. Fines and jail terms escalate with subsequent offenses.
Controlled Substances (Drugs)
Sanctions upon convictions for possession, distribution, or manufacture of controlled substances range from fines to imprisonment. Amounts of fines, terms of probation or years of imprisonments are generally contingent upon the circumstances and amounts of drugs in possession, sale, distribution or manufacture. Penalties for drug possession are governed by the Texas Health and Safety Code, Subtitle C.
